The legal name of DEIAX-AQUOS® is DEIAX-GLOBAL SLU, with address at Carretera de Andratx 32, local 4, 07181 Calvià, Illes Balears, and CIF B16528606. It is a company specialized in the distribution and installation of water treatment and filtration systems.

 

1. Responsibility

DEIAX-AQUOS® assumes no civil responsibility for water quality. This responsibility lies with the contracting party. It is the customer’s responsibility to immediately inform DEIAX-AQUOS® by email at info@deiax-aquos.com or by phone in case of any signs of anomalies in the water (taste, odor, color, or other conditions) at 971 77 83 60 or 616 325 317. It is the customer’s responsibility to promptly inform DEIAX-AQUOS® if the device exhibits any of the alarms indicated in the device manuals. The cleaning device should never be turned off for more than 1 week (electricity and water), as the device performs an automatic membrane cleaning system and there is a risk of bacteria growth if it is turned off and no water flows. Otherwise, the membrane would have to be repaired, and the equipment disinfected. These costs would be borne by the customer. Water quality can damage devices, especially hardness. In the case of softeners, it is the customer’s responsibility to always maintain the softener and always have salt in it. Otherwise, the devices can be damaged, as they require little hardness to function properly (less than 10 dH). This is the case, among others, with many osmosis devices, water dispensers, pressure groups, and UV sterilizers. In this case, the customer will be liable for any damage to the device. In case a dormant state is required for an extended period and you wish to turn off the device, contact DEIAX-AQUOS® or follow the recommendations in the manufacturer’s manuals. In all installations, it is the customer’s responsibility to monitor the installation for the next 48 hours after installation in case of a water leak. DEIAX-AQUOS® is not responsible for damages to your property or home caused by a water leak related to the installed and sold equipment, especially if the leak persists for hours or days and the customer has not shut off the water supply. If a leak is present and reported immediately (hours after installation), in most cases, no major damage will occur. DEIAX-AQUOS® is not responsible for water leaks that have been apparent for hours, days, or weeks and have not been reported by the customer. In case of a leak during the warranty period for the installation (3 months), DEIAX-AQUOS® will send a technician and repair the leak free of charge, as long as it is related to our equipment. DEIAX-AQUOS® is exclusively liable for problems or damages arising after an installation by DEIAX-AQUOS®. Any manipulation of the equipment without authorized and certified personnel is the customer’s responsibility. Products must only be used according to the manufacturer’s terms of use, which are described in their manuals. If these products are used for other purposes, DEIAX-AQUOS® is not responsible for the damages caused. However, nothing in these General Terms and Conditions affects the consumer’s legal rights due to faulty products or otherwise.

All devices that treat water, especially for human consumption, require regular filter changes (every 6 or 12 months depending on the model) and disinfection of the devices to eliminate any microorganisms that could contaminate the machine over time. It is recommended that disinfection be carried out by qualified personnel, but DEIAX-AQUOS® also has disinfection kits for DEIAX-AQUOS® end customers. This is particularly important for water purifiers and dispensers. In the case of UV lamps that disinfect water, especially those without UV technology, it is the customer’s responsibility to maintain the pre-filtration well and to change the UV lamp once a year to ensure effective water disinfection.

Within 14 days of purchase or installation of your product, the customer will inspect the products for visible defects and/or damages. In this case, the customer will not use the products in question and will contact DEIAX-AQUOS® to exchange the products in question.

DEIAX-AQUOS® exclusively supplies products for professional, domestic, and private use. If the customer uses the products for other commercial or resale purposes, DEIAX-AQUOS® is not liable to the customer.

In the case of commercial sales, DEIAX-AQUOS® cannot be held responsible for loss of profits, business interruption, or missed business opportunities. This responsibility lies with the contracting party.

In any case where material is damaged during installation, such as scratching, perforation, breakage of furniture, etc., in materials or objects such as furniture, sinks, marble, countertops, bars, walls, floors, etc.; both parties will reach a commercial agreement to resolve the issue. In case the parties do not reach an agreement, the customer will have to submit 1 budget and DEIAX-AQUOS® another budget from companies in Palma de Mallorca with at least 5 years of experience in the industry. Once submitted, the average of the two budgets will be chosen, and the costs will be shared equally through an official invoice to both parties.

All installed machines are determined where the machines are installed. Any change of location must be reported in writing to info@deiax-aquos.com and receive the consent of DEIAX-AQUOS®. Otherwise, DEIAX-AQUOS® is not responsible for problems, complaints, or damages related to the relocation of a machine.

 

2. Termination of contract

If a customer becomes bankrupt or breaches this agreement (and in the case of a remediable breach, if the customer remedies the breach within 14 days of notification by DEIAX-AQUOS®), DEIAX-AQUOS® may terminate this agreement.

 

3. Warranties:

DEIAX-AQUOS® relies on the warranties of the manufacturers of the equipment it sells or rents, as specified in the manuals of the devices and machines. DEIAX-AQUOS® installations have a 3-month warranty. In all installations, photographs are taken after installation, and DEIAX-AQUOS® is only responsible if the equipment has been handled by DEIAX-AQUOS® or certified personnel. Equipment warranties only apply if the customer performs the maintenance specified by the manufacturer through qualified and certified personnel.

Purpose of processing: The purpose of collecting and processing data is to carry out administrative management and billing and to keep you informed about our services and offers. Conduct market studies to measure the quality of our services through satisfaction surveys.

Retention period: The period of retention of data in the client’s state corresponds to the period for which the company’s accounting and tax information is necessary at the request of the competent public authority (tax authority or judicial authorities).

Legitimation: Data processing is based on the contractual relationship for the provision of services.

Recipients of the data (assignments or transfers): The data controller will not transfer or disclose the personal data stored in its files to third parties, except in cases provided by law or when necessary for the provision of the service.

Rights: You can exercise the rights of access, rectification, limitation, portability, deletion, or, where appropriate, opposition. To exercise your rights, you must send a letter to the address indicated above or to the following address: info@deiax-aquos.com. You must indicate which of these rights you wish to exercise and must in turn attach a photocopy of your ID card or equivalent identification document. In case you act through a legal or voluntary representative, you must also submit a document proving the representation and the identification document of the same.

Court: All legal disputes will be resolved before the courts of Palma de Mallorca, Spain.

Social media: DEIAX-AQUOS® reserves the right to publish photos of installations and products on social networks such as Instagram, Facebook, LinkedIn, and others (always without the presence of individuals). If the customer wishes to withdraw a photo, the customer has the right to do so by notifying DEIAX-AQUOS® at the following address: info@deiax-aquos.com.
